4-11-4: LIMITATIONS ON LICENSES; TRANSFERABILITY:
   A.   Any license now issued and which may hereafter be issued to engage in the business of operating taxicabs on or over the streets and public ways shall mean and be construed to be only a license or privilege to use the street and public ways for the business of operating taxicabs thereon.
   B.   There shall not be issued to the owner of taxicabs by the city clerk or other authority authorized to issue licenses under the direction of the governing body a greater number of licenses than one taxicab license for one taxicab for each one thousand five hundred (1,500) persons of the population of the city, based on the most recent Unites States official census.
   C.   Such licenses shall be apportioned to the various applicants therefor as the governing body may determine the public interest requires. (2003 Code § 5-09-04)
   D.   Licenses issued under the provisions of this chapter shall be transferable, subject to the consent and approval of the governing body; provided, however, that no license may be issued to another or to any other persons until such licensee or person has applied for a license and has been found to be qualified to obtain such license under all of the provisions of this chapter; provided further, that upon the approval of the transfer of any license as herein provided, the city clerk shall charge and collect a fee in such amount as established by resolution of the city council for transferring said license and issuing the new license card and plate as provided for in this chapter.
