A. Time Limit; Consideration: Within fifteen (15) days after the filing of the notice of appeal with the city clerk or at the next regular meeting of the city council, the city council shall consider the appeal. Written notice of the time and place the city council will consider the appeal shall be mailed by the city clerk to the appellant at least five (5) days before the date set for hearing unless the appellant shall waive this notice in writing. Appearance at the hearing by the appellant shall be waiver of notice in any event.
B. Decision Of City Council: In any appeal, the city council shall consider the application, the report submitted by the city clerk, and other pertinent information presented, and may grant or deny the permit subject to the conditions, terms, and regulations set forth in this chapter. The decision of the city council shall be final.
C. Notification Of Decision: The city clerk shall notify the appellant in writing of the decision of city council by placing the written notification in the United States mail, at the address provided in the application. (2003 Code § 5-12-11)
