4-10-3: APPROVAL REQUIRED:
   A.   Permit Required: No person shall produce, direct, conduct, manage, institute, or carry on any special event without first obtaining the appropriate permits from the city. No person shall promote, advertise, encourage, or solicit attendance or otherwise participate in any way in a special event for which no permit has been issued, or for which such permit has been suspended or revoked.
   B.   Issuing Official: Approval of a special event may be issued only by the mayor of the city.
   C.   Constitutional Rights: For any special event involving the exercise of rights protected by the first and fourteenth amendments of the United States constitution, or article 1, section 4, 9 or 10 of the constitution of the state of Idaho, the application shall be processed promptly, without charging a fee for political or religious activities, without imposing terms or conditions that infringe constitutional freedoms, and in a manner that respects the liberties of the applicants and the public. Events involving commercial activity are presumed to be of a commercial nature and subject to the provisions of this chapter, except when such commercial activity conveys a constitutionally protected communication.
