(A) The property owner shall be primarily responsible for the payment of all charges arising out of the use of all utilities consumed and/or utilized at his or her premises (whether or not the premises is leased to or otherwise occupied by another, and whether or not a mobile home belonging to another is located upon the premises), or any other charges provided for in this chapter and assessed by the Town Board. Such charges shall constitute a perpetual lien and continuing lien upon such property until paid in full, and no water shall be furnished to any property against which any charge hereunder remains unpaid.
(B) All bills for utilities sold and/or furnished by the town shall be due and paid to the Town Finance Officer prior to midnight of the fifteenth day of the month, and if not paid by such date, the bill shall be deemed delinquent. Late charges shall be set as the Town Board in its discretion shall, from time to time, declare by resolution.
(C) If any delinquent property owner, or property owner otherwise not complying with the terms of this chapter, remains delinquent or in noncompliance for a period of 60 days, the town may give such property owner notice by certified mail stating that if said bill is not paid within, and/or the noncompliance is not corrected within, ten days of receipt of such notice, any or all of the utilities furnished to or for the benefit of the premises shall be discontinued or disconnected, and in such cases, the town is hereby authorized to discontinue and/or disconnect any or all such utilities. No discontinued and/or disconnected utility shall be resumed or reconnected until payment of the delinquent account to such premises is paid in full, or the noncompliance is corrected, as the case may be, and in addition thereto, a reconnection fee is paid to the town for each service account disconnected. Reconnection fees shall be set as the Town Board in its discretion shall, from time to time, declare by resolution. Appeal may be made to the Town Board.
