§ 50.01  UTILITY RATE REGULATIONS.
   (A)   General. There is hereby established a monthly charge for each utility sold or furnished to each premises served as follows. Wherever the utility sold or furnished to any premises shall exceed the normal amount for such premises so that the fee prescribed is not fair and reasonable as applied to that particular premises, the town may establish a special rate therefor.
   (B)   Water.
      (1)   Rates for water service shall be set as the Town Board in its discretion shall, from time to time, declare by resolution. Such rates shall apply to each water meter serving the premises.
      (2)   In cases where a meter fails to accurately register the amount of water passing through the meter from any cause whatsoever, the quantity used shall be determined, and the charge made, based upon the average amount used during two or more preceding months of water use. The property owner shall immediately notify the town of breakage, stoppage, or any other irregularity in performance of the meter.
      (3)   No water shall be used or taken from the town water system without being metered, unless the use shall have the express advance written consent therefor from the town, and in such cases the rate of charge shall be determined by the town.
   (C)   Sewer. Rates for sewer service shall be set as the Town Board in its discretion shall, from time to time, declare by resolution.
   (D)   Garbage.
      (1)   Rates for garbage service shall be set as the Town Board in its discretion shall, from time to time, declare by resolution.
      (2)   If the party liable for payment of the service to a single family unit is age 65 or older, and such party furnishes proof of such age to the town, the rates for such service shall be set as the Town Board in its discretion shall, from time to time, declare by resolution.
      (3)   Rates and commercial classification for garbage service to a commercial business shall be set as the Town Board in its discretion shall, from time to time, declare by resolution.
   (E)   Temporary disconnects. Any owner of residential real property which is occupied part time or seasonally may request a temporary disconnect of water, sewer, and garbage service to such property. Disconnect/reconnect charges shall be set as the Town Board in its discretion shall, from time to time, declare by resolution.
   (F)   Waste tires. Same as above as determined by the Town Board.
