§ 95.10 VEHICLE SALE REGULATIONS.
   (A)   Findings, intent and purpose. The village has determined that the number and manner in which vehicles are offered or made available for sale requires regulation to protect the public health, safety and welfare and the character and safety of the village and its neighborhoods and streets. The intent and purpose of this section is to preserve those values by regulating vehicle sale displays and signs and establishing responsibility for ordinance compliance and violations.
   (B)   Definitions. For purposes of this section the following terms shall have the meanings indicated. Terms not defined shall have their common meaning or as defined elsewhere in this code.
      LOT. A separate parcel of occupied or vacant land that is identified by a separate address or tax parcel identification number.
      SIGN. Words, numbers, figures, devices, designs or objects, on or in any form, which is visible from a street or any public or private property except the lot upon which the sign is located.
      VEHICLE. A car, truck, bus, motorcycle or other motor vehicle, recreational vehicle including but not limited to a travel trailer, fifth wheel, motor home, camper, watercraft, snowmobile and off-road or all-terrain vehicle, and utility or other trailers designed for transporting or storing another vehicle.
   (C)   Prohibited displays, signage and locations. Unless specifically authorized, licensed and/or permitted under the village zoning and other applicable ordinances, it shall be unlawful:
      (1)   To park, store, place or allow the parking, storage or placement of a vehicle on property in the village with a sign that attracts attention to, advertises or provides any information regarding a vehicle that is or may be offered for sale, lease or transfer, attached or affixed to the interior or exterior of the vehicle.
      (2)   To erect, maintain or allow the erection or maintenance of a sign on property in the village that attracts attention to, advertises or provides any information regarding a vehicle that is or may be offered or available for sale, lease or transfer.
      (3)   On any lot, to park, store, place or allow the parking, storage or placement of more than one vehicle that is advertised, offered or available for sale, lease or transfer.
      (4)   To park, store, place or allow the parking, storage or placement of a vehicle that is advertised, offered or available for sale, lease or transfer in any location on a lot other than the driveway or within a street right-of-way.
   (D)   Violations, persons responsible, citations and enforcement.
      (1)   Violations of this section shall be municipal civil infractions and be punishable and processed as provided in Chapter 32 of this code.
      (2)   The owners and occupants of a lot that is used, and registered owners or leaseholders of a vehicle that is parked, stored or placed in violation of this section shall each be individually responsible for the municipal civil infraction.
      (3)   In any prosecution for a violation of any provision of this section, proof that the particular vehicle described in the complaint was parked, stored or placed in violation of any provision of this section, together with proof that the defendant named in the complaint was, at the time of the violation, the registered owner or leaseholder of such vehicle or owner or occupant of the lot at which the violation occurred, shall constitute prima facie evidence that the defendant is a person responsible for the violation.
      (4)   Whenever any vehicle is found to have been parked, stored or placed in violation of any provision of this section, and the registered owner/leaseholder responsible for the violation is not immediately available for personal service, the officer finding such vehicle may serve a citation by conspicuously affixing it to the vehicle and sending a copy to the registered owner or leaseholder at their address of record with the Secretary of State.
      (5)   The provisions of this chapter may be enforced by officers of the Franklin-Bingham Police Department, any Ordinance Enforcement Officer for the village authorized pursuant to Chapter 32 of this code or other village officer or official authorized by the Village Charter.
