§ 30.38 ESCROW ACCOUNT.
   (A)   The village may require the escrow of monies in the amount of the estimated costs and expenses to be incurred in the village review. Payment from such escrow shall be based upon a written billing or other written accounting for the village review undertaken with written documentation of costs and expenses to be maintained for inspection by the person providing the funds.
   (B)   If the amount or escrow is or will be inadequate to cover all of the costs and expenses of the village review, the village may require supplemental monies to be place in escrow for completion of the village review.
   (C)   to the extent an escrow exceeds the final actual costs and expenses of the village review, the excess shall be returned to the person that posted the escrow at their last known address. If the escrow cannot be returned in that manner and has not been claimed by the person who posted it within six month of the village's first written notice of the excess, the village may deposit the excess escrow to the general fund of the village or hold it for distribution in accordance with the laws of the State of Michigan.
