§ 131.21 MINOR IN POSSESSION OF MARIHUANA.
   (A)   Offense. It shall be unlawful for a person under 21 years of age to possess, consume, purchase, or otherwise obtain, cultivate, process, transport, or sell marihuana.
   (B)   Penalty.
      (1)   A person under 21 years of age who possesses no more than 2.5 ounces of marihuana or who cultivates no more than 12 marihuana plants shall be subject to the following penalties:
         (a)   For a first violation:
            1.   A civil infraction, and if less than 18 years of age, by a fine of not more than $100 or community service, forfeiture of the marihuana, and completion of four hours of drug education or counseling; and
            2.   If the person is at least 18 years of age, by a fine of not more than $100 and forfeiture of the marihuana;
         (b)   For a second or subsequent violation:
            1.   If the person is under 18 years of age, a civil infraction, a fine of not more than $500 or community service, forfeiture of the marihuana, and completion of eight hours of drug education or counseling; and
            2.   If the person is at least 18 years of age, by a fine of not more than $500 and forfeiture of the marihuana; or
      (2)   If the minor is in possession of marihuana in an amount greater than 2.5 ounces, the penalty shall be $500 and/or 93 days in jail.
