Sec. 48-194. Permit application.
   An applicant for a city permit shall submit, on a form provided by the Big Spring Police Department, a complete, verified application containing or accompanied by the following:
      (1)   The true name, the trade name, physical address and mailing address, and telephone number of the towing company.
      (2)   The name, date of birth and physical home address and mailing address of the applicant if a sole proprietorship.
      (3)   The name, date of birth and physical home address and mailing address of each partner if the applicant is a partnership.
      (4)   The name, date of birth and physical home address and mailing address of each corporate officer, if the applicant is a corporation.
      (5)   The name, physical address and driver's license number of every tow truck driver employed by the applicant who will be conducting police tows.
      (6)   The physical address of the applicant's vehicle storage facility and a photocopy of the state license for the facility.
      (7)   Copies of certificate of liability insurance showing a minimum amount of insurance coverage that complies with the requirements of Section 85.400, Title 16, Texas Administrative Code, for said owned or contracted vehicle storage facility.
      (8)   A certificate from the city/county tax assessor-collector that all city taxes on all properties, real and personal, to be used in connection with the applicant's business are current.
      (9)   A certificate of liability insurance issued by a company authorized to do business in the state which identifies coverage in the amounts required under this article.
      (10)   For each tow truck the applicant intends to use:
         a.   The make, model, size and model year;
         b.   The vehicle identification number;
         c.   The state license plate number;
         d.   The state issued permit # for each listed tow truck; and
         e.   A photocopy of the certificate of registration issued by the state.
      (11)   Copies of appropriate authorized tow licenses issued for each tow truck driver.
      (12)   Copies of certificate of liability insurance for Incident Management tows, for the minimum amounts mandated by Section 2308.103, Texas Occupations Code and Section 86.400, Title 16, Texas Administrative Code, for tow trucks and tow trucks cargo.
      (13)   Any indemnification requirements of the city;
      (14)   Provide that each permit holder shall be an independent permit holder and shall not, with respect to their acts or omissions, be deemed an agent or employee of the City of Big Spring.
      (15)   Consent form authorizing to the inspection of tow trucks, tow truck equipment and storage facilities by the chief of police or his designee between the hours of 8:00 a.m. and 5:00 p.m. on weekdays. This authority shall be cumulative of any other authority held by the chief of police, other law enforcement officials or other legally authorized public officials.
      (16)   Signed agreement stating that the tow truck company will, within four business days of performing each police tow, provide to the Big Spring Police Department an itemized copy of the tow bill associated. This may be done by sending a copy of the itemized tow bill to records@bigspringpd.net.
      (17)   Signed agreement with the Big Spring Police Department that any police tows that are directed to be taken to the LEC impound lot or city contracted vehicle maintenance garage for the purpose of evidence, violation of insurance ordinance, or repair, the Big Spring Police Department will be charged a flat rate of $200.00 per towed vehicle. This fee may be requested to be part of a requested tow fee study.
