Each permit issued pursuant to the provisions of this article shall be conditioned that, by the acceptance of such permit, the holder thereof releases the city fully and completely from any and all damages that might be sustained by the holder thereof or his wife or husband, children or guests using, enjoying or being on Moss Creek Lake or the area surrounding such lake and owned and operated by the city. No person may use Moss Creek Lake or the area surrounding such lake and owned and operated by the city, without releasing the city from liability from any and all damages that might be sustained by such person and their children and guests, whether a permit is required or not. Use of the premises shall constitute acceptance of this release.
