This article adopts procedures pursuant to Texas Transportation Code Title 7, Chapter 683, Subchapter E on junked vehicles as public nuisances, and their abatement. For the purposes of this article, the following words shall have the meaning hereinafter given:
Aircraft has the meaning assigned by Texas Transportation Code § 24.001.
Antique vehicle means a passenger car(s) or truck(s) that is at least 25 years old.
Hearing office means the city council or the court of competent jurisdiction conducting a hearing under this article.
Junked vehicle means a vehicle that is, and is:
(1) Visible at any time of the year from a public place or public right-of-way; and
(2) Self-propelled; and
(3) Is:
(a) Wrecked, dismantled or partially dismantled, or discarded; or
(b) Inoperable and has remained inoperable for more than:
(i) Seventy-two consecutive hours, if the vehicle is on public property; or
(ii) Thirty consecutive days, if the vehicle is on private property;
(4) And is:
(a) A motor vehicle that displays an expired license plate or does not display a license plate;
(b) An aircraft that does not have lawfully printed on the aircraft an unexpired federal aircraft identification number registered under Federal Aviation Administration aircraft registration regulations in 14 C.F.R. Part 47; or
(c) A watercraft that:
(i) Does not have lawfully on board an unexpired certificate of number; and
(ii) Is not a watercraft described by Parks and Wildlife Code § 31.055.
(5) The definition of "junked vehicle" includes a part or parts of such a vehicle.
Motor vehicle means a vehicle that is subject to registration under Texas Transportation Code, Title 7, Chapter 501.
Motor vehicle collector means a person who:
(1) Owns one or more antique or special interest vehicles; and
(2) Acquires, collects, or disposes of an antique or special interest vehicle or part of an antique or special interest vehicle for personal use to restore and preserve an antique or special interest vehicle for historic interest.
Motor vehicle demolisher means a person in the business of:
(1) Converting motor vehicles into processed scrap or scrap metal; or
(2) Wrecking or dismantling motor vehicles.
Property owner/occupant means the owner or occupant of:
(1) The real property on which the vehicle is located; or
(2) If the vehicle is located on a public right-of-way, the property adjacent to the right-of-way.
Requestor means one who requests a hearing under this article, and is either an owner or lienholder of the vehicle, or a property owner/occupant.
Special interest vehicle means a motor vehicle of any age which has not been changed from original manufacturer's specifications and, because of its historic interest, in being preserved by hobbyists.
Storage facility includes a garage, parking lot, or establishment for the serving, repairing, or parking of motor vehicles.
Watercraft means a vessel subject to registration under Parks and Wildlife Code Chapter 31.
