Broken windows in the downtown area shall be fixed and boarded up windows may only be temporary, effective January 5, 2022.
(a) Definitions.
(1) Downtown area. The downtown area shall be composed of the contiguous area between Goliad Street and Gregg Street, and First Street and Sixth Street.
(2) Repair time period. Within 30 days of having broken.
(b) If broken, any exterior window in a building in the downtown area shall be repaired within the repair time period with transparent or translucent material pursuant to applicable ordinances and laws.
(c) A violation of this section by an owner or other person having control over the property shall be unlawful.
(d) The city shall have authority to abate and repair broken windows upon the notice and procedures of the Structural Standards Ordinance. If the city abates the broken window, the city shall hire a qualified, insured installer, at its discretion, and the expense of such materials and labor shall be paid by the property owner. Should the property owner not pay the city the cost, the city shall set a lien against the property for the cost.
(e) The city manager may set the officer or officers who enforce this section. If the city manager does not set the officer or officers, the building official, code enforcement officers, and the fire marshal and his deputies shall have the power to administer and enforce this section.
(f) The city manager shall have the authority to extend the repair time period for a particular window or a particular structure for 30 days, and this authority may be used to extend the repair time period up to one year.
