(a) It shall be unlawful for any person, firm or corporation to maintain a swimming pool that is not enclosed by a barrier.
(b) Definition. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:
Barrier means structure either manmade or natural that is at least 48 inches above the ground, measured on the side of the barrier away from the swimming pool or at least 72 inches above the ground measured on the side of the barrier facing the swimming pool. The barrier must have not more than ten-degree slope from vertical. No opening in the barrier may be greater than five inches with the exception of a gate or door. A gate or doorway must have a latch or lock at least 48 inches above the ground.
Swimming pool means any structure intended for swimming that contains water over 24 inches deep.
