After an application is filed under this division, the city secretary shall refer the same to the city manager for action, and if the city manager or his representative is convinced from the evidence submitted that the owner of the carnival is solvent and that he has in the past, and proposes to while showing in the city, conducted the carnival in a law-abiding manner, the city manager or his representative shall approve the application.
