For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
NOXIOUS WEED. As defined in MCA § 7-22-2101(9).
NUISANCE WEED. All weeds, grass, wild vegetation and other unsightly, troublesome or useless vegetation over 12 inches in height growing within the boundaries of the town and any other untended vegetation creating a potential fire hazard, or a visual or physical hazard for vehicles or pedestrians, as determined by town employees, Council members or the Mayor.
