§ 93.17 NOTICE TO REMOVE OR ABATE NUISANCE.
   (A)   Upon becoming aware of conditions set forth herein, the Mayor or his or her designated representative shall make a determination whether or not the conditions and circumstances constitute a nuisance as herein defined, and if it is determined that the conditions, if not abated, will constitute a nuisance, the official shall give notice to the owner, tenant or person in control of the premises, or an agent thereof, to remedy the condition within ten days. The notice shall be given to the owner, tenant or person in control of the premises, or an agent thereof, in writing in the following manner:
      (1)   If the owner, tenant or person in control of the premises, or an agent thereof, and his or her residence is known, the notice shall be:
         (a)   By personal service to the owner, tenant or person in possession, by the Mayor or his or her designated representative, or any peace officer of the city; and/or
         (b)   By registered mail with return receipt requested addressed to the last known address of the owner.
      (2)   If the ownership of the building is unknown, then the notice shall be considered served by attaching a copy of it in a place of prominence on the building; and
      (3)   When a complaint under this section has been made as to the condition of a particular property, the ownership of which has been granted or accrued to the heirs of any deceased person, and if the names of the heirs are unknown, the notice shall be directed against them, their heirs or legal representatives, describing them as the heirs of the named ancestor.
   (B)   The notice shall state the nature of the nuisance on the private property and that it must be removed or abated within ten days, and further that a request for a hearing must be made before the expiration of the ten-day period if the owner, tenant or person in control of the premises, or agent thereof, wishes to appeal the determination.
   (C)   If the nuisance is not removed and abated and a hearing is not requested within the ten-day period provided, a complaint may be filed in Municipal Court for the violation of maintaining a nuisance on private property.
