§ 140.05 Withdrawal from Administrative Citation Process.
Within seven days of the date of issuance of the notice of violation, an offender may withdraw from participation in the administrative citation process established in this section by delivering written notice of withdrawal by mail or in person to the City Clerk or to the City Police Department. The written notice shall state the name of the individual, indicate whether they are contesting the alleged violation, the amount of the penalty, and the reason and facts upon which the individual is contesting the citation. If an individual withdraws from the process, the city may thereafter file criminal charges in accordance with state law and established court procedures. Failure to withdraw from the process within the time specified in this subsection will be construed as an offender’s election to participate in the city’s administrative citation process.
