(A) Cart defined. It shall be illegal to operate a motorized vehicle not licensed for use on the highways of Indiana, hereinafter referred to as a
CART
on the public rights-of-way of the town except in conformity with this section. Off-road vehicles, ATVs, lawn mowers and the like are not permitted on town roads.
(B) Drivers. No cart shall be operated on a town right-of-way:
(1) By any person who has not obtained an operator's license under I.C. 9-24-3 or a public passenger chauffeur's license under I.C. 9-24-4;
(2) By any person on any sidewalk or state or federal highway within the town;
(3) At a speed greater than 25 mph;
(4) By any person after sunset and before sunrise unless the cart is equipped with an operable headlight and tail lamp;
(5) By any person unless the cart is equipped with a “slow moving vehicle sign” approved by the state and displayed in the rear, and a warning flag between 8 feet and 12 feet high, and at least 60 square inches in size, also displayed in the rear;
(6) By any person unless every person riding has a seat;
(7) By any person unless the cart is owned or leased by an improved property owner, property owner holding a current valid building permit or resident of the town. An improved property owner, property owner holding a current valid building permit or resident shall register the cart annually with the town and shall deliver proof of insurance and a serial number to the Clerk-Treasurer’s office. A parking permit for such use is required for operating a cart on a town right-of-way and shall be permanently affixed to the cart as provided in division (D) below; and
(8) Without proof of liability insurance.
(C) Hand signals. All cart operators shall clearly signal their intentions for the operation of their carts by universally utilized hand and arm signals given from the left side of the cart as follows:
(1) Left turn: hand and arm extended horizontally;
(2) Right turn: hand and arm extended upward; and
(3) Stop or decrease speed: hand and arm extended downward.
(D) Parking. No cart shall be permitted to park in those areas of the town designated for “Parking by Permit Only” unless the vehicle is owned by an improved property owner, property owner holding a current valid building permit or resident of the town and displays a current Beverly Shores parking permit issued by the Clerk-Treasurer's office. The parking sticker shall be displayed in the same fashion as a motor vehicle or as determined by the Town Marshal.
(E) Traffic laws. The operator of a cart shall obey all traffic and parking regulations currently in force and, in the event of a violation, the operator shall be liable for the same fines and penalties as are provided for other vehicles, and illegally parked carts shall be subject to being removed and impounded.
