(A) In the event a person charged with a violation for conduct which also violates a state statute elects to contest that violation in a court of competent jurisdiction, the Town Marshal is authorized to amend the Town Code of Ordinances violation into a state statute violation.
(B) Thereafter, the amended violation shall be prosecuted, pursuant to state law, by the County Prosecutor.
