(A) (1) In the event a person charged with a speed limit, stop sign or U-turn violation under the Town Code of Ordinances pays the appropriate fine set forth in § 10.98 within 30 days from the date that person is cited, the violation will not be reported to the Indiana Bureau of Motor Vehicles.
(2) In the event a person charged with a violation under the Town Code of Ordinances does not pay the appropriate fine set forth in §§ 10.97 or 10.98 within 30 days from the date that person is cited, the matter may be filed as a complaint with the Porter County Superior Court unless that person enters a written denial of the violation in accordance with division (C) below.
(3) Except for a speed limit, stop sign, U-turn or parking violation, any subsequent violation of the same provision of the Town Code of Ordinances by the same person may be subject to the general penalty provisions of § 10.97 of the Town Code.
(B) Fines shall be paid to, receipted and accounted for by the Town Clerk-Treasurer under procedures provided for by the State Board of Accounts. Payment of fines and penalties under this chapter may be made in person, by mail, or to an agent or agents designated by the Town Council.
(C) Procedure to contest a violation.
(1) A person charged with an ordinance violation under this chapter who contests the violation shall file a written denial of the violation with the Clerk-Treasurer within 30 days after the date of the violation was issued. The denial shall include the violation number, the name, address and telephone number of the person charged, and the basis for the denial.
(2) The Town Council will review the denial of the violation and shall notify the violator that the Town Council shall conduct a public hearing concerning the denial of the violation and that the violator has the right to appear at the public hearing and present evidence. After the public hearing, the Town Council may either uphold the issuance of the violation, dismiss the violation or continue the matter for further consideration and determination at a later date.
(3) If the Town Council upholds the violation, a written notice will be mailed to the person charged with the violation under the Town Code of Ordinances and that person will have 30 days from the date of mailing to pay the fine. If the person charged with a violation under the Town Code of Ordinances does not pay the fine within 30 days after the date of the mailing of the Town Council’s upholding the violation, the matter may be filed as a complaint in the Porter County Superior Court.
