§ 10.17 REPEAL EXCLUSIONS.
   (A)   All sections not herein provided for are expressly declared repealed and invalid except that nothing in this code shall effect any section:
      (1)   Promising or guaranteeing the payment of money for the town, or authorizing the issuance of any bond of the town or any evidence of the town's indebtedness, or any contract or obligations assumed by the town, including, but not limited to Ord. 84-27 (street lighting contract with NIPSCO) as amended; park bond issue and special taxing district bonds as amended;
      (2)   Granting any right or franchise, including, but not limited to Ord. 84-13 (NIPSCO electric franchise) as amended; Ord. 84-14 (NIPSCO gas franchise) as amended; Res. 96-02 (to induce a cable television franchise; Ord. 97-02 (cable television franchise) as amended;
      (3)   Dedicating, naming, establishing, locating, relocating, opening, paving, widening, vacating and the like, any street or public way in the town;
      (4)   Making any appropriation, including, but not limited to any and all appropriations of bond proceeds; establishing or making any budget of the town;
      (5)   Levying or imposing taxes, creating or establishing or reauthorizing any funds or fund programs; including, but not limited to Ord. 97-06 (cumulative capital development fund);
      (6)   Establishing or prescribing grades in the town;
      (7)   Providing for local improvements and assessing taxes therefor;
      (8)   Dedicating or accepting any plat or subdivision or otherwise relating to subdivisions not codified by this section;
      (9)   Extending, describing or contracting the boundaries of the town;
      (10)   Prescribing the number, classification benefits or compensation of any town officers, elected officials, employees of the town or the town utilities or departments establishing annual salary schedules and ordinances, not inconsistent herewith;
      (11)   Pertaining to zoning which is not codified by this section or within this code of ordinances;
      (12)   Adopted for purposes which have been consummated;
      (13)   Which is temporary, although general in effect;
      (14)   Which is special, although permanent in effect; or
      (15)   Relating to the master plan which is not codified in this section or code of ordinances, including, but not limited to Ord. 84-28 and Ord. 84-34 (Comprehensive Plan), as amended, and the zoning map(s) made a part of Ord. 208 (Chapter 155) as amended; Comprehensive Plan as amended, and any and all of the maps which are made a part of the plan.
   (B)   All like sections are hereby recognized as continuing in full force and effect to the same extent as is set out in length in this code. Like sections are on file in the office of the Clerk-Treasurer.
