§ 31.08 DRUG-FREE WORKPLACE AND AWARENESS PROGRAM.
   (A)   Prohibitions and penalty.
      (1)   Prohibited conduct. The unlawful manufacture, distribution, dispensation, possession or use of a controlled substance is prohibited in the workplace by any employee of the town.
      (2)   Penalty for violation.
         (a)   Employees in the workplace in violation of any prohibition in division (A)(1) above, shall be summarily discharged from their employment.
         (b)   Police officers are subject to disciplinary proceedings before the Town Council as a Board of Safety pursuant to state statute.
   (B)   Program.
      (1)   Each employee shall be given a copy of a statement of the town’s drug-free awareness program and each employee must sign a statement that they have read the statement of the drug-free awareness program, that they will abide by the terms of the statement and that they will notify the town of any criminal drug statute convictions for a violation occurring in the workplace no later than 5 days after conviction.
      (2)   The signed statement shall be kept by the Clerk-Treasurer in the employee’s personnel
file.
