§ 130.02 BOWS AND ARROWS; DISCHARGE REGULATIONS.
   No person shall hunt by the discharge of bows and arrows or use archery devices of any kind except during the following times and under the following conditions.
   (A)   During the regular state hunting season, as promulgated by the Indiana Department of Natural Resources, or other state authority.
   (B)   During the deer reduction zone hunting season, in each year that the Indiana Department of Natural Resources, or applicable state authority, includes the town within a deer reduction zone.
   (C)   All state hunting regulations shall apply.
   (D)   There shall be no field dressing of any deer within the town.
   (E)   No discharge of bows shall be permitted during the following times:
      (1)   The Saturday and Sunday preceding October 31;
      (2)   October 31;
      (3)   Thanksgiving Day - the first Sunday following Thanksgiving Day; and
      (4)   December 23 - January 3.
   (F)   No discharge of bows on Saturdays or Sundays, except on properties of two acres or more.
   (G)   No discharge of bows within 300 feet of any town park, including, but not limited to Lituanica Park.
   (H)   During the applicable hunting season, discharging of bows is permitted from a half hour before sunrise until a half hour after sunset, unless a more limited window is prescribed by the Indiana Department of Natural Resources, or other state authority.
   (I)   Bow discharge permit regulations and qualifications:
      (1)   All prospective bowmen must submit the following in order to receive a bow discharge permit from the Town Marshal:
         (a)   Mandatory hunter education or bow hunter education certificate;
         (b)   Proof of proficiency testing administered by hunter education instructor or conservation officer;
      (2)   Upon receipt of the required documentation, the Town Marshal shall issue a bow discharge permit. The total number of permits issued, and any expiration period, shall be subject to the Marshal's sole and absolute discretion. However, there may be no more than ten bowmen in town and utilizing a permit on any given day. Each permit must be returned to the town at the time of expiration;
      (3)   Bowmen must register with the Town Marshal arrow identification and vehicle registration; and
      (4)   The Town Marshal may, in his or her sole and absolute discretion, cancel and invalidate any existing permits for safety purposes or violations of state or local law.
   (J)   Bow discharge regulations:
      (1)   Discharge of bow sites must consist of 30,000 square feet; two or more contiguous property owners may combine to establish 30,000 square feet;
      (2)   Each bowman must have a signed permission slip by the owner of the property and also signed by the bowmen;
      (3)   Each bowman must submit a copy of their signed permission slip to the Town Marshal. Along with this, the bowmen must submit a copy of a plot map showing property boundaries proving 30,000 square feet and designation of where the discharge of bows will take place on the property;
      (4)   Discharging of bows allowed only in rear and side yards;
      (5)   No discharging of bows within 50 feet of neighbor's property without a signed permission slip;
      (6)   Tree-stand discharge only, unless terrain and hunting conditions dictate otherwise; and
      (7)   No discharging of bows at a deer at a distance of more than 15 yards.
   (K)   Violation of any of the above regulations will result in the bowmen and/or the property owner losing the privilege to discharge bows on their property, in addition to other potential penalties and fines.
