(A) Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.

Placing food stuff into the open so that it is accessible to deer on a scale that any quantities more than a wheel barrow or bushel constitutes

(B) Prohibited conduct; penalties.
(1) Any person who knowingly creates and/or maintains a low-level feeder (less than 5 feet high) open or ground feeder, salt or mineral blocks, engages in large scale feeding of deer (1 bushel or more), shall be subject to a fine of $50 first offense, $100 for each subsequent offense thereafter.
(2) Any person who knowingly feeds deer on a town road right-of-way shall be subject to a fine of $50 first offense, $100 for each subsequent offense thereafter.
(3) Each violation of this section shall be fined an amount not to exceed $2,500 every day any violation of this section occurs. Each day constitutes a separate violation of this section and a separate offense. Each violation of this section in a court prosecution shall result in a minimum fine of $250. The fine provided for in this division (B)(3) shall be the maximum fine which shall be imposed in those cases where other provisions provide for a minimum fine but do not provide for a maximum fine.
