§ 154.79 DEFERRAL OF REQUIRED IMPROVEMENTS.
   (A)   The Council may defer at the time of final subdivision approval, subject to appropriate conditions, the provision of any or all off-site improvements as in its judgment are not requisite in the interests of the public health, safety and general welfare or which are inappropriate because of inadequacy or lack of connecting facilities, incompatible grades, future planning or for other reasons.
   (B)   Whenever it is deemed necessary by the Council to defer the construction of any improvement required herein, the subdivider shall pay his or her share of the costs of the future improvements to the city prior to signing of the final subdivision plat or the developer may post a bond insuring completion of the improvements upon demand of the city prior to signing of the final subdivision plat. The deferral shall not exceed five years, unless extended by the Council.
   (C)   In cases involving minor subdivisions, as defined herein, where all off-site improvements are not in place, and where the tract is zoned for residential single-family or two-family use, the requirement for the construction of the required off-site improvements shall not be waived, but the requirement to post bond may be waived at the discretion of the Council and the installation of off-site improvements may be postponed until the time that an operational project can be accomplished by an improvement district.
   (D)   A building permit may be issued prior to the installation of and acceptance of all required improvements where the subdivider has obtained a deferral under the provisions of this section.
   (E)   A certificate of occupancy may be issued prior to the installation and acceptance of all required improvements only where the subdivider has paid his or her share of the costs of the future improvements to the city prior to signing of the final plat or where improvements have been postponed until the time that an operational project can be accomplished by an improvement district.
