When the subdivider has completed construction and installation of required off-site improvements, the procedure for acceptance of the off-site improvements shall be as follows:
(A) The subdivider shall make written request to the city through the office of the City Engineer that the off-site improvements be accepted by the city. In addition, he or she shall be required to submit the following through the offices of the City Engineer:
(1) One set of reproducible "as- built" plans and specifications certified and signed by a registered, licensed engineer;
(2) A written statement from the project engineer indicating that the off-site improvements have been constructed in accordance with the approved plans and that the "as- built" plans are a true and accurate representation of the off-site improvements;
(3) A maintenance bond in an amount considered to be adequate by the City Engineer, guaranteeing the maintenance of all paved streets, sidewalks and alleys for a period of five years and guaranteeing the maintenance of all sanitary sewers, storm sewers, water lines and fire hydrants for a period of two years; and
(4) Payment for any and all costs of testing as set forth in the standard specifications.
(B) The City Engineer shall submit a written report to the City Manager indicating the following:
(1) The off-site improvements either have or have not been constructed in compliance with approved plans and specifications and all other requirements of the city code;
(2) The "as-built" plans either provide or do not provide a true and accurate representation of the off-site improvements;
(3) All required maintenance bonds have been submitted and are in an amount considered adequate by the City Engineer; and
(4) The applicant has submitted payment for any and all costs of testing as set forth in the standard specifications.
(C) Upon the City Manager's receipt of the written report from the City Engineer, the report shall be submitted to the Council for their acceptance of improvements and required maintenance bonds.
(D) If the Council finds the off-site improvements and all associated requirements to be in compliance with the city's code, the improvements shall be accepted for maintenance as well as the required maintenance bonds therefor. The approval shall constitute authorization for recording the final plat and/or for release of the performance bond where applicable.
