§ 154.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALLEY. A minor public right-of-way primarily designed to serve as secondary access to the side or rear of those properties whose principal frontage is on some other street.
   APPLICANT. The owner of the land proposed to be subdivided or his or her representative. Consent shall be required from the legal owner of the property.
   BLOCK. A parcel of land, intended to be used for urban purposes, which is surrounded by public streets, highways, railroad rights-of-way, public walks, public parks or green strips, rural land or drainage channels or a combination thereof.
   BUILDING. Any structure built for the support, shelter or enclosure of any persons, animals, chattels or movable property of any kind.
   BUILDING LINE or SETBACK LINE. A line or lines designating the area outside of which buildings may not be erected.
   CITY. The City of Bethany, Oklahoma.
   CITY CLERK. The City Clerk of Bethany.
   CITY STAFF. The city administrative staff.
   COLLECTOR STREET. Any street intended to move traffic from local streets to secondary or primary arterials or major thoroughfares. A COLLECTOR STREET serves a neighborhood or large subdivision.
   COMPREHENSIVE PLAN. The comprehensive development plan for the city which has been officially adopted to provide long-range development policies for the area subject to urbanization in the foreseeable future and which includes, among other things, the plan for land use, traffic and community facilities.
   COUNCIL. The City Council of Bethany.
   CUL-DE-SAC. A local street with only one outlet and having an appropriate terminal for the safe and convenient reversal of traffic movement.
   EASEMENT. Grant or authorization by the property owner to the public, a corporation or persons, for the use of a strip of land for specific purposes.
   GRADE. The slope of a road, street or other public way, specified in percentage terms.
   LOCAL STREET.
      (1)   A street intended to provide access to collectors or thoroughfares.
      (2)   The designation as to the classification of streets shall be based on the principles established in the comprehensive plan.
      (3)   If a question exists as to the functional or design classification of streets the Planning and Zoning Commission shall make the final determination.
   LOT. A tract, plot or portion of a subdivision or other parcel of land intended as a unit for the transfer of ownership or for building development.
   LOT ADJUSTMENT COMMITTEE. Committee composed of the City Engineer, City Building Inspector and Community Development Coordinator.
   LOT, CORNER. A lot located at the intersection of and abutting on two or more streets.
   LOT, DOUBLE FRONTAGE. A lot which runs through a block from street to street and which has two nonintersecting sides abutting on two or more streets.
   LOT LINE ADJUSTMENT. A relocation of the lot lines of two or more lots included in a plat which is filed of record, for the purpose of making necessary adjustments to building sites.
   LOT, REVERSE FRONTAGE. A double frontage lot which is to be developed with the rear yard abutting a major street and with the primary means of ingress and egress provided on a minor street.
   MAJOR SUBDIVISION. Any subdivision not classified as a minor subdivision including but not limited to subdivisions of tracts which are two acres or greater in area or which are to be subdivided into four or more lots, or any size subdivision requiring any new street or drainage improvements or extension of municipal facilities or the creation of any public or off-site improvements.
   MAJOR THOROUGHFARE. A road or street intended to move through traffic to and from major attractions such as central business districts, shopping centers, colleges, places of employment and similar traffic generators and/or as a route for traffic between communities or large areas.
   MINOR SUBDIVISION. Any subdivision of a tract of less than two acres comprising the total area of a single ownership which is to be subdivided into three or fewer lots fronting on an existing street, not involving any new street or road or drainage improvements or the extension of municipal facilities or the creation of any public or off-site improvements.
   OFF-SITE IMPROVEMENTS. Any utility, structure or modification of topography which is, or will be, located within, under or over a right-of-way or easement of record and which is, or will be, owned and/or maintained by other than the individual owner(s) of developed real estate.
   OPEN SPACE BUFFER. An open area that is excluded from development which consists of natural plantings that will function to significantly reduce the sight and sound of the use of the property being developed.
   PLANNING COMMISSION. The City Planning and Zoning Commission.
   PLAT, FINAL. A map of a land subdivision prepared in a form suitable for filing of record with necessary affidavits, dedications and acceptances and with complete bearings and dimensions of all lines defining lots and blocks, streets and alleys, public and other dimensions of land.
   PLAT, PRELIMINARY. A map of a proposed land subdivision showing the character and proposed layout of the tract in sufficient detail to indicate conformity of the proposed subdivision with the purposes of the comprehensive plan and these regulations.
   RESUBDIVISION. A change in a map of an approved or recorded subdivision plat if the change affects any street layout on the map or area reserved thereon for public use or creates any additional lots.
   REVERSE STRIP. A part of the property being subdivided which is platted and restricted so as to prohibit access to an adjacent public easement or right-of-way.
   STREET. Any public or private right-of-way which affords the primary means of access to abutting property.
   SUBDIVIDER. Any person, firm, partnership, corporation or other entity, acting as a unit, subdividing or proposing to subdivide land as herein defined.
   SUBDIVISION. The division or re-division of land into two or more lots, tracts, sites or parcels for the purpose of transfer of ownership or for development, or the dedication or vacation of a public or private right-of-way or easement or the recording of property previously divided, as provided for by these regulations contained herein.
   SUITABLE EFFECTIVE SCREENING. An open space buffer consisting of natural plantings, fencing or similar material that will significantly reduce the penetration of noise from an adjacent street.
