(A) Adoption of codes.
(1) (a) There is hereby adopted for the purpose of establishing rules and regulations for construction, alteration, removal, demolishing, equipping, using and occupancy, location, maintenance of buildings and structures, including permits and penalties, those certain building codes known as:
1. The International Building Code, the latest editions adopted by the State of Oklahoma and its amendments OCA 748:20-1-3 to 748: 20-1-19, as published by the International Code Council, hereinafter referred to as "Building Code;" and
2. The International Fire Code, 2018 edition, including Appendix Chapters D, N (see International Fire Code § 101.2.1, 2018 edition), as published by the International Code Council, is hereby adopted as the Fire Code of the City of Bethany, Oklahoma, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the city are hereby referred to, adopted, and made a part hereof, as if fully set out in this section, with the additions, insertions, deletions and changes, if any, prescribed herein. Three copies of the International Fire Code, 2018 edition, including Appendix Chapters D, N, are on file in the office of the City Clerk.
a. That the following sections of the International Fire Code, 2018 edition, including Appendix Chapters D, N, are hereby revised:
i. Section 101.1; Insert: "the City of Bethany."
ii. Section 101.1.2; Insert: "Fees for permits and other services shall be set by the City Council of the City of Bethany via resolution."
iii. Section 102. 1.( 5); Insert: "Existing structures that have been unoccupied or condemned for more than 90 days."
iv. Section 106.6; Insert: "Reinspection fees. A fee of $75 will be assessed for each reinspection. Each reinspection shall be deemed a separate visit, and a separate reinspection fee will be assessed."
v. Section 107.2.3; Insert: "Reinspection requests. Work shall not be done beyond the point indicated in each successive inspection. Upon correction of any portion of the construction that the Fire Code Official indicated does not comply with this code, it shall be the duty of the holder of the permit or their duly authorized agent to notify the Fire Code Official when work is ready for reinspection. It shall be the duty of the permit holder to provide access to and means for inspections of such work that are required by this code."
vi. Section 110.4; Insert: "misdemeanor; $750 plus court costs, ten days"
vii. Section 112. 4. Insert: "$500 plus court costs; $750 plus court costs."
viii. Section 5504.2.1; Insert: "Flammable cryogenic fluids in stationary containers are only allowed in Heavy Industrial (I-2) Zoning Districts."
ix. Section 5704.2.9; Insert: "Storage of Class I and Class II liquids in aboveground tanks is only allowed in Heavy Industrial (I-2) Zoning Districts."
x. Section 6104.2; Insert: "The storage of liquefied petroleum gas is restricted from being placed near heavily populated areas and is only allowed in Heavy Industrial (I-2) Zoning Districts."
b. i. To ensure compatibility with the present key box system and related devices, the manufacturer of such devices shall be the Knox Company and will be required on all commercial buildings with fire alarms or fire suppression systems and other occupancies as determined by the Fire Code Official.
ii. A life/fire safety inspection may be conducted upon request from a business. The inspection report may be used for state/ federal agency requirements. A person or business that requests this inspection shall pay $150.
c. That the geographic limits referred to in certain sections of the 2018 International Fire Code are hereby established as follows:
i. Section 5704.2.9.6.1. (geographic limits in which the storage of Class I and Class II liquids in aboveground tanks outside of buildings is prohibited): "within the corporate limits of the City of Bethany."
ii. Section 5706.2.4.4. (geographic limits in which the storage of Class I and Class II liquids in aboveground tanks is prohibited): "within the corporate limits of the City of Bethany."
iii. Section 5806.2. (geographic limits in which the storage of flammable cryogenic fluids in stationary containers is prohibited): "within the corporate limits of the City of Bethany."
iv. Section 6104.2. (geographic limits in which the storage of liquefied petroleum gas is restricted for the protection of heavily populated or congested areas): "within the corporate limits of the City of Bethany."
d. The Fire Code hereby adopted shall be enforced by the City Fire Department, under the supervision of the Fire Chief. The Fire Chief of the city may detail such members of the City Fire Department as inspectors or Fire Code Official as shall be necessary to enforce such code.
e. The Fire Chief of the City Fire Department shall have power to modify any of the provisions of the Fire Code hereby adopted, upon application in writing by the owner or lessee, or his/her duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code; provided that the spirit of the Fire Code hereby adopted shall be observed, public safety secured, and substantial justice done. The particulars of such modification, when granted or allowed, and the decision of the Fire Chief of the City Fire Department thereon shall be entered upon the records of the City Fire Department, and a signed copy shall be furnished to the applicant.
(b) Save and except the portions of each as are hereinafter deleted, modified or amended, of which no less than one copy of each have been and now are filed in the office of the City Clerk. The Building Code and the Life Safety Code are hereby adopted and incorporated as fully as if set out at length herein.
(2) From the date on which this section shall take effect, the provisions of the Building Code and the Life Safety Code as herein modified shall be controlling in the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of all buildings and structures within the corporate limits of the city. As the Building Code and Life Safety Code are subsequently amended or modified, the changes shall be incorporated herein by reference.
(3) The following insertions and deletions are made to the Building Code:
(a) The words "the City of Bethany, Oklahoma" are inserted in the second line of Section 101.1;
(b) The words "The permit fees for performing the activity described in this chapter shall be set periodically by the City Council of the City of Bethany, Oklahoma, by duly adopted resolution, and the fees may be amended by resolution of the Bethany City Council." are inserted into Section 109.2.
(c) The words "the City of Bethany, Oklahoma, Oklahoma County, revised May 2, 1995" are inserted in the second line of Section 1612.3.
(d) Chapter 34 has been deleted and is replaced by the International Existing Building Code.
(e) Section 101.4.6 pertaining to the provisions of the International Energy Conservation Code are deleted.
(f) The following design criteria are inserted into Table R301.2(1) of the International Residential Code (adopted by reference in Section 101.2 of the International Building Code):
Column 1- Ground Snow Load: 10 psf
Column 2- Wind Speed: 90 mph
Column 3- Seismic Design Category: C
Column 4- Weathering: Moderate
Column 5- Frost Depth Line: 18 inches
Column 6- Termite: Yes
Column 7- Winter Design Temperature: 13 Deg F
Column 8- Ice Barrier Underlayment Required: No
Column 9- Flood Hazards: FIRM dated 2, July 2002
Column 10- Air Freezing Index: 333
Column 11- Mean Annual Temperature: 61.0 Deg F
(g) The words "thirty" and "twenty-four" are inserted in the third and fifth lines respectively of Section 2603.5.1 of the International Residential Code adopted by reference in Section 101.4 of the International Building Code).
(B) Amendments to Residential Code for 1 and 2 Family Dwellings and Townhouses. The provisions of the International Residential Building Code One- and Two-Family Dwellings and Townhouses is hereby amended and modified as approved by the Oklahoma Uniform Building Code Commission and as set forth in 748:20-5-5.1 to 748:20-5-24.1.
