(A) A qualified person may become a candidate for the Office of Council member or Mayor by filing a declaration of candidacy with the County Election
Board during the time period established by the Charter of the city.
(B) (1) A declaration for candidacy shall be accompanied by a cashier's check or certified check payable to the County Election Board in the amount of $50.
(2) The filing fee shall be forfeited to the County Election Board and the proceeds applied to the costs of the election as charged to the city by the County Election Board unless the candidate is unopposed in the election or receives more than 15% of the votes cast for the office for which the person filing was a candidate, in which case the check shall be returned to the candidate immediately.
