§ 131.04 TRESPASS.
   (A)   (1)   No person shall trespass on public property or school property.
      (2)   For the purpose of this division, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
         OFFICIAL SIGN. Any permanently fixed notice posted by the federal, state or municipal government owning or maintaining any public property.
         PUBLIC PROPERTY. The property which is dedicated to the public use and over which the federal, state or municipal governments or any political subdivision thereof exercises control and dominion.
         SCHOOL PROPERTY. Any property or institution devoted primarily to the education of children from pre-school through the 12th grade.
         TRESPASS. Each and every actual entry upon public property in violation and contrary to the provisions of any official sign posted to regulate and govern the entry or use.
   (B)   (1)   No person shall trespass on private property.
      (2)   For the purpose of this division, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
         PRIVATE PROPERTY. Any property other than public property.
         PUBLIC PROPERTY. The meaning ascribed to it in division (A) above.
         TRESPASS.
            1.   Each and every actual entry upon the premises of an owner or other person in lawful possession of the premises without the express or the implied consent of the owner or other person in lawful possession.
            2.   TRESPASS shall also mean remaining upon the premises of an owner or other person in lawful possession after having been told to leave the premises by the owner, or the agent, or employee of the owner, or other person in lawful possession of the premises.
            3.   TRESPASS shall also be defined as the act of remaining on private property at any time other than during posted hours of business operation after having been directed to vacate the premises by a police officer; provided that the provisions of this sentence shall not apply to persons, including employees, whose presence upon the premises is authorized by the owner or by a person in lawful possession of the premises; nor shall the provisions of this sentence apply unless hours of business operation are posted upon the premises.
            4.   TRESPASS shall also be defined as the act of returning to private property before the posted time of opening for business operation on the next business day after having been directed to vacate the premises under the terms of this section.
            5.   TRESPASS shall also be defined as the act of remaining on premises, whether private or public, when such is posted forbidding the act at any time other than during the posted hours of business operation.
