§ 112.01 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BASEMENT. The portion of a building or structure having one-half or more of its clear height below the ground level.
   CHILD. Any person who has not attained the age of 18.
   DAY CARE. Supplemental care of a child away from the home in which he or she resides, and provided by someone other than the child's natural parents, custodians or legal guardians for periods of less than 24 hours per day and on a regular schedule more often than once a week. This definition does not include babysitting or custodial care. BABYSITTING or CUSTODIAL CARE means care of a child by a non-professional person in an occupied residence, which is not conducted on a regular schedule, where the caregiver is not compensated and where no advertising is done in any way.
   DAY-CARE CENTER. Both nurseries and family day-care homes, as defined in this subchapter.
   DIRECTOR. The City Manager or his or her designee.
   ELECTRICAL APPLIANCE. Any device which utilizes electricity to produce light, heat or power.
   EXIT. A means of egress which is specifically designed for that purpose giving access from one floor to another or to the ground level outside the building.
   FAMILY DAY-CARE HOME.
      (1)   An occupied residence which receives seven or fewer children for day care. This number includes the caregivers' own children under five years of age who are present in the home while children are in care and the children of any substitutes or assistant caregivers.
      (2)   This requirement is based on the rules of the State Department of Human Services, and, in the event the number of children is increased or decreased by the State Department of Human Services, then the maximum number of children allowed herein shall likewise be adjusted.    FIRE CHIEF. The Chief of the City Fire Department or his or her designated representative.
   GAS APPLIANCE. Any device which utilizes gas fuel to produce light, heat or power.
   INFANT. Any person who has not attained the age of two.
   NURSERY. Any day nursery, nursery school, foster home or preschool, or any place, home or institution which receives six or more children, including the parents' own preschool children under five years of age living in the nursery, but excluding all other members of the family occupying the premises, for day care or foster care, when received on a regular schedule more often than once a week. This definition does not include public and private schools organized, operated and approved under the laws of the state, but it does include churches or other religious or public institutions caring for children within the institutional building.
