§ 95.005 KEEPING SWINE, GOATS AND THE LIKE.
   (A)   It shall be unlawful for any person, firm or corporation to keep, maintain or feed swine, goats, emu or ostrich within the city.
   (B)   The keeping of potbellied pigs within the city is specifically prohibited, except as follows:
      (1)   Only those potbellied pigs, as hereinafter defined, which are located within the city on the effective date of this chapter may continue to be located in the city under the following conditions for their lifetime. For purposes of this chapter, only those potbellied pigs which are registered through a bona fide registry firm may be licensed within the city. To qualify to be kept under this exception the potbellied pig must have been located in the city on the effective date of this chapter, and must be licensed with the city no later than 30 days from the effective date of this chapter.
      (2)   The keeping of not more than two licensed potbellied pigs or similar small swine per lot or premises under this exception shall be subject to the following conditions:
         (a)   For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
            POTBELLIED PIGS. Asian potbellied pigs, Shar-pei pigs, Vietnamese, Chinese or Asian pigs or other similar swine meeting the provisions of this section.
         (b)   Each potbellied pig shall be a pet that is to be kept for personal enjoyment and not kept or raised for human consumption.
         (c)   Each potbellied pig shall be licensed with the city under conditions as the animal control division deems appropriate, including, but not limited to rabies vaccination, if available, and registered through a bona fide registry firm. The license shall be renewed annually at the same time, at the same cost, and under the same conditions as dog licenses hereunder.
         (d)   A potbellied pig shall not exceed 75 pounds in weight and 21 inches in height.
         (e)   There shall not be more than two potbellied pigs more than three months of age per lot or residence.
         (f)   The keeping of potbellied pigs for commercial breeding purposes is prohibited in the city.
         (g)   The premises where potbellied pigs are kept shall be maintained so that noxious odors are controlled.
            1.   Any person who keeps, maintains or harbors a potbellied pig shall keep it confined on the premises.
            2.   The confinement shall be accomplished by the following means:
               a.   A fence or similar enclosure to prevent escape;
               b.   Keeping inside a house or other building; and
               c.   Keeping on a leash to prevent escape.
