Tobacco/e-cigarette businesses within 300 feet of any school licensed on or before October 18, 2022 are exempt from the provisions of this chapter as long as its business license remains effective. If a non-conforming, tobacco/e-cigarette business license has not been renewed in more than a year, the business shall no longer be exempt from this provision. A business license for a tobacco/e-cigarette business is non-transferrable. If a non-conforming business is sold, the new owner will have to comply with all restrictions of this chapter.
