(A) The city has determined that the volume of solid waste it is transporting to landfills is excessive and constantly growing and that the cost of disposal for that volume continues to increase. Landfilling of solid waste has a negative impact on the environment and the rising cost of disposal places undue strain on the city's finances. It is the policy of the city to seek and implement methods for the reduction of the solid waste stream, including, but not limited to recycling, composting and incentives for source reduction.
(B) The City Council may establish, by resolution, the measures as it deems appropriate for the control and reuse of solid waste. To that end, the Council may regulate, alter or limit the types of solid waste disposed, the frequency and location of disposal, the type and style of containers to be used, the disposition of the solid waste collected or the solid waste byproducts generated, volume-based fees and other conditions as may be necessary to achieve the purpose of the measures.
(C) When a resolution, adopted pursuant to this section, requires the segregation of solid waste or specifies a type and style of container for certain solid waste, then it shall be unlawful and an offense for any resident, owner or rental agent to fail to segregate the solid waste, to dispose or attempt to dispose of other solid waste in the same container as the solid waste to be segregated or to use containers other than those specified.
