(A) The city has determined there are persons within the city who are disposing of solid wastes in locations other than permitted sites. The unauthorized disposal constitutes a health hazard. It is the policy of the city to control unauthorized disposal by requiring all persons with the need for disposal of solid wastes to do so through services of the city.
(B) Every resident, owner or rental agent shall dispose of garbage and refuse through the exclusive use of the city's solid waste service. Each household shall be supplied with one City of Bethany poly cart. The property owner is responsible for keeping track of their poly cart(s). If the cart is lost or stolen, prompt notification to the city is required. If the city determines that the cart was damaged, destroyed or stolen through abuse, neglect or improper usage by the resident, then the cost of repair or replacement shall be charged to the resident at current repair or replacement cost. If a cart has deteriorated or become damaged from normal wear and tear to the extent that the lid will not fit, or wheels do not function properly, or any other defect that would hamper the collection process, then the cart shall be replaced by the city at no additional cost to the resident. It shall be unlawful and an offense:
(1) To fail to make provision for the use of city service; and
(2) For any person to store or retain garbage upon his or her property for more than one week without allowing or providing for city disposal.
(C) Any property maintained in violation of this section is hereby declared to be a public nuisance.
