§ 51.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CONTAINER. A City of Bethany provided poly cart or dumpster.
   GARBAGE. A class of solid waste which includes every accumulation of animal or vegetable matter, or both, or refuse matter from kitchens, pantries, dining rooms or other parts of hotels, restaurants, boarding houses, dwelling houses, market houses, public institutions, butcher shops, poultry stores and fish stores.
   PROHIBITED SOLID WASTE. Garbage, refuse, trash or any other solid waste or waste material, including solids, semi-solids, liquids or a contained gas that, because of its quantity, concentration or physical, chemical or infectious characteristics, may cause or significantly contribute to or increase mortality or an increase in serious personal injury or illness; or poses a substantial present or potential hazard to human health and the environment when improperly treated, stored, transported or disposed of, or otherwise managed; or which poses a threat of causing serious personal injury or illness to personnel; or has the potential of damaging vehicles or equipment collecting the solid waste.

   RECYCLABLE MATERIALS. Any types of solid waste designated by the city to be separated for recycling.
   REFUSE. A class of solid waste which includes inflammable and combustible material, paper, boxes, excelsior, waste, tin cans, broken ware, clothing, shoes and ordinary waste accumulated by family residents.
   RESIDENT, OWNER or RENTAL AGENT. Any person, firm or corporation having charge of, supervision of or the manufacture of any dwelling house, apartment house, rooming house or business of any nature in the city.
   ROADSIDE. At or near the curb line of the street from which the property is serviced, or if there is no curb, where the road meets the yard or drive from which the property is serviced where the cart is not concealed or enclosed by a fence, vegetation or other barrier, including but not limited to behind parked cars, behind hedges, or within four feet of either a mailbox or tree. The container shall not be placed on the sidewalk.
   SOLID WASTE. All manner of matter, other than sanitary sewer, dirt, rock or building materials which any resident, owner or rental agent seeks to discard or dispose for any reason.
   TRASH. A class of solid waste which includes trees, limbs, leaves and grass and excessive boxes, papers and other combustible material.
