§ 50.02 REVIEW AND RECOMMENDATION ON RATES.
   (A)   The City Manager shall annually review the city's water rate structures to insure that the city's income shall be sufficient to meet the city's need. The City Manager shall, from time to time, recommend a rate structure to the City Council. The proposed rate structure shall include water fees, late payment penalties, deposits and any other fees or payments deemed necessary.
   (B)   A sewer use fee structure shall be established according to the following requirements:
      (1)   Fees shall be reviewed at least bi- annually and revised periodically to reflect actual operation and maintenance costs of the treatment works so as to:
         (a)   Maintain the proportionate distribution of operation and maintenance costs among users; and
         (b)   Generate sufficient revenue for total operation and maintenance costs.
      (2)   The city shall prepare and maintain all records necessary to document compliance with the provisions of this section.
   (C)   (1)   The City Council shall, by resolution, approve and set an effective date for any water rate structure or sewer use fee structure before it shall become effective. The structure shall be published in a newspaper of general circulation in the city at least once 15 days prior to the effective date as set by the Council.
      (2)   Users of the sanitary sewer system shall be notified monthly of the wastewater treatment service charge portion of utility billing. The City Clerk shall keep a copy of the structures in the City Clerk's office for public inspection.
