§ 54.04 STORMWATER MANAGEMENT PROGRAM ESTABLISHED.
   (A)   The purpose of this section is to establish stormwater management program in order to regulate discharges to the city's stormwater drainage system to the maximum extent practicable as required by federal and state law. This section establishes methods for controlling the introduction of pollutants into the municipal separate storm sewer system (MS4) in order to comply with requirements of the national pollutant discharge elimination system (NPDES) permit requirements. The objectives of this section are:
      (1)   To regulate the contribution of pollutants to the municipal separate storm sewer system by stormwater discharges by any person;
      (2)   To control the introduction to the municipal separate storm sewer system of spills, dumping, or the disposal of materials other than stormwater;
      (3)   To prohibit illicit connections and illicit discharges to the municipal separate storm sewer system;
      (4)   To establish legal authority to carry out all inspection, surveillance and monitoring procedures necessary to determine compliance and noncompliance with this part;
      (5)   To establish procedures for enforcement of this chapter;
      (6)   To establish abatement and remediation procedures for this chapter; and
      (7)   To establish penalties for non- compliance with this chapter.
   (B)   The intent of the program is to address regulations of the U.S. Environmental Protection Agency (EPA) which recognizes stormwater runoff to be one of the major contributors to water pollution worldwide.
