The City Council of the City of Bethany, Oklahoma, makes the following findings in the consideration and adoption of this chapter:
(A) Storm water flooding causes a significant risk to the property, health, and safety of the citizens of Bethany, Oklahoma.
(B) The City of Bethany has large areas within its city limits which may be subject to flooding during heavy rains.
(C) The drainage facilities of the City of Bethany, Oklahoma, consist largely of natural drainage ways, barrow ditches, and improved storm drainage facilities.
(D) The public storm water drainage facilities are in need of maintenance, repair, and improvement, but there is insufficient revenue of the city to perform the required improvements, maintenance, and repair.
(E) A monthly utility service charge should be imposed on the users of the storm sewer system to assist in the maintenance, repair, and improvement of the storm sewer system of the City of Bethany.
