(A) Before commencing the erection, maintenance or use of any scaffolding, an operator must obtain proof, satisfactory to the Building Director or his designee, that the operator has successfully completed a training course in scaffolding safety, which course shall be approved by the Building Director or his designee. Each natural person who participates in any way in the erection, maintenance or use of such scaffolding must obtain separate proof that he or she has successfully completed an approved training course.
(B) Before commencing the erection of any scaffolding, the operator must obtain insurance against any liability, loss or claim caused by or arising from the erection, disassembly, maintenance or use of the scaffolding. Such insurance shall be issued by an insurer authorized to do business in the State of Illinois, shall be in an amount of no less than $1,000,000 per occurrence and shall name the City of Berwyn and its officials (whether appointed or elected), officers, employees and agents as additional insureds. The insurance shall be maintained in full force and effect at all times that the scaffolding is present.
(C) Before commencing the erection of any scaffolding, the operator must obtain a bond in an amount to be determined by the Building Director or his designee. The bond shall be executed by a surety company authorized to transact business in the State of Illinois as surety on the bond with the applicant as principal on the bond and the city as obligee. Such bond shall be conditioned on the applicant faithfully performing his duties and complying with this Code and all other applicable ordinances, codes, statutes, laws, orders, rules and regulations regarding scaffolding. The bond shall indemnify and hold harmless the city from any and all liability that may result from the erection, disassembly, maintenance or use of the scaffolding.
(D) The owner and the operator shall keep copies of all required proof of training and proof of insurance at the scaffold site and at the offices of the owner and the operator. The owner and the operator shall produce the required proof of training and proof of insurance for inspection upon the request of city personnel.
(E) The scaffolding permit for a building may be deemed invalid and revoked for any violation of this section.
(F) The proof of training and insurance required by this section shall be in addition to all other applicable code requirements.
