§ 1443.04 CERTIFICATES OF OCCUPANCY.
   (A)   In general. A certificate of occupancy, indicating completion of the work for which a building permit was issued, shall be obtained prior to the occupancy of any structure, except as provided for in division (D) hereof.
   (B)   Certificate required. No newly constructed or newly altered building shall be occupied or used, in whole or in part, for any purpose until a certificate of occupancy therefor has been issued by the Director, stating that the building and premises comply with all the building and health regulations of the city and the provisions of this Building Code. No person shall change the use of any premises or building, or part thereof, now or hereafter erected or altered, in a manner which is not consistent with the regulations, and no person shall change the use without first obtaining a permit to make the change, unless it is in conformity with this Building Code.
   (C)   Application. A person who wishes a certificate of occupancy shall apply for it at the same time he or she applies for a building permit. The certificate shall be issued within 30 days after completion of all work described in the application and construction documents.
   (D)   Temporary certificates. Pending the issuance of a certificate of occupancy, a temporary certificate of occupancy may be issued pending the completion of the construction authorized by the permit. The temporary certificate of occupancy shall not be construed as in any way altering the respective rights, duties or obligations of the owners or the city relating to the use or occupancy of the premises or any other matter covered by this Building Code. The temporary certificate of occupancy shall not be issued, except under restrictions and provisions as will adequately ensure the safety of the occupants. No temporary certificate of occupancy shall be issued if, prior to its completion, the building being constructed or altered does not comply with this Building Code, to a degree as to render it safe for the occupancy proposed.
   (E)   Records. A record of all certificates of occupancy and temporary certificate of occupancy shall be kept on file in the office of the Director, and copies thereof shall be furnished on request to persons having a proprietary or tenancy interest in the building.
