(A) The city has determined that it is in the best interests of its residents and in furtherance of the public health, welfare and safety to institute a program for the recycling of recyclable materials within the Recyclable Materials Program Area.
(B) The Recyclable Materials Program includes the weekly collection of recyclable materials at alleyside that is separate from the normal collection of refuse but which must be collected on the same day as the normal collection of refuse, using trucks and equipment specifically designed for the collection of recyclable materials.
(C) No person shall purchase and/or collect recyclable materials within the Recyclable Materials Program Area except for the city’s designated refuse disposal contractor.
(D) From the time of placement of recyclables at an alley in recycling containers for collection in accordance with the city’s Recyclable Materials Program, the recyclable materials shall remain the property of the householder until a time as they are collected by the designated refuse disposal contractor. It shall be a violation of this chapter for any person unauthorized by the city to collect or cause to be collected any items. Any and each collection in violation of this section from one or more locations shall constitute a separate and distinct offense, punishable as hereinafter provided in this chapter. However, from time to time, upon written application of a charitable or civic organization, Council may authorize the organizations to collect or pick up certain recyclable materials.
