§ 1028.07 TREE TOPPING.
   (A)   No person, firm or city department shall top any street tree, park tree or other tree on public property to such a degree as to remove the normal canopy and disfigure the tree. Trees severely damaged by storm or other causes, or certain trees under utility wires or other obstructions where other pruning practices are impractical, may be exempted from this section and will be scheduled for future removal by the Director of Public Works.
   (B)   Non-emergency vegetation management activities will be subject to the State of Illinois Public Act 92-0214. Public Act 92-0214 requires such activities shall:
      (1)   Follow the most current tree care and maintenance standard practices set forth in ANSI A300 published by the American National Standards Institute and the most current applicable Occupational Safety and Health Administration regulations regarding worker safety.
      (2)   Provides requirements of direct notice of vegetation management activities.
      (3)   Requires compliance of franchise, contract or written agreements between the public utility and municipalities.
   (C)   The public utility will be required to follow the provisions included Public Act 92-014 in taking actions directly related to an emergency to restore reliable service.
