§ 1020.01 TEMPORARY USE OF STREETS; PERMITS; LIMITATIONS.
   (A)   A person who wishes to use a public street, roadway, court, alley or parkway in the city for the purpose of storing or depositing any building material, machinery, tool, tool box, tool shed, fuel or other supply, for any building or structure in the course of being constructed, moved, altered or repaired, shall first make application in writing to the Director of Public Works for permission to do so. The application shall describe the location of the street, roadway, court, alley or parkway proposed to be occupied, the use to be made of the same, and the length of time of the intended occupation. Should the Director approve of the application, he or she shall grant permission to the applicant, provided that the applicant has complied with all the other provisions of this chapter and other city ordinances relating to buildings, as to bonds, fees and all other requisites in connection with the intended use. Permission to use a street, roadway, court, alley or parkway is intended only for imperative use in connection with the actual erection, repair, alteration, wrecking or removal of buildings or structures, and shall terminate with the completion of the operation or at an earlier time as the Director finds feasible and requires. No permission shall be granted for a period longer than 90 days.
   (B)   No person shall occupy a sidewalk or street after the completion of the operation for which the permit has been issued. No person shall occupy a sidewalk or street for the storage of articles not intended for immediate use in connection with the operation for which the permit has been issued.
   (C)   The occupation of the sidewalk or street for the storage of building material shall not exceed one-third of the width of the roadway, and in all cases where the obstruction of the street is made, there shall be a clear space of not less than one foot between the obstruction and the curb line. However, the Director may limit or entirely restrict the storage of materials on a street or alley where a tunnel, conduit or any underground passageway or subway is located. The permit required in this section does not authorize the occupation of a sidewalk or street, or part thereof, other than that immediately in front of the lot upon which a building is in the process of erection and in relation to which the permit was issued. During the progress of building operations, a sidewalk not less than six feet in width shall be at all times kept open and unobstructed for the purpose of passage in front of the lot. The sidewalk shall, if there are excavations on either side of the same, be protected by substantial railings, which shall be built and maintained thereon so long as excavations continue to exist.
