The city shall provide approved modular news racks for placement on public rights-of-way in the modular news rack districts.
(A) The modular news rack shall be purchased by the city in accordance with specifications approved by the Building Director. Each publication shall pay to the Licensing Director an annual lease fee of $25 for each dispensing device within the modular news rack it utilizes, and shall be responsible for keeping the news rack and surrounding area in a neat clean condition free of loose newspapers and other debris, and in good repair. The publication shall be responsible for the cost of any repairs or replacement due to damage of any news rack under its control outside of the modular news rack districts.
(B) After the initial installation of modular news racks, the total number of dispensing devices in modular news racks in the modular news rack districts may be increased or decreased consistent with the purposes stated in the City Code. Modular news racks shall be placed by the city in locations throughout the districts which afford easy, convenient service to pedestrians, but which do not obstruct or interfere with access to abutting properties, and which do not impede or endanger pedestrian, vehicular, or bicycle traffic.
(C) There shall be no newspaper dispensing device of any type located within the modular news rack districts except as part of a city-approved and city-installed modular news rack. All existing newspaper dispensing devices shall be removed from the public rights-of-way within seven days after placement of the modular news rack. Any device not so removed shall be subject to confiscation by the Public Works Department. Any non-conforming news rack placed on city rights-of-way shall be subjected to confiscation as set forth in § 859.07.
