§ 859.01 DEFINITIONS.
   The following words or phrases shall have the meanings set forth:
   ABANDONED. Any newspaper dispensing device or any compartment of a modular news rack that does not contain the newspaper or publication specified for more than four consecutive calendar days for a daily publication, eight consecutive calendar days for a weekly publication, 16 consecutive calendar days for a bi-weekly publication, 32 calendar days for a monthly publication, or 64 days for a bi-monthly publication.
   DIRECTOR. The Building Director of the City of Berwyn. The Building Director may designate a representative.
   MODULAR NEWS RACK. A news rack designed with multiple separate enclosed compartments to accommodate at any one time the display, sale, or distribution of multiple distinct and separate newspapers or other publications.
   MODULAR NEWS RACK DISTRICT. The following areas of the city are hereby designated modular news rack districts: Roosevelt Road from Lombard Avenue to Harlem Avenue; 16th Street from Lombard Avenue to Harlem Avenue; 26th Street from Lombard Avenue to Harlem Avenue; Cermak Road from Lombard Avenue to Harlem Avenue; Stanley Avenue from the Illinois Central Railroad to Harlem Avenue; Windsor Avenue from the Illinois Central Railroad to Harlem Avenue; Oak Park Avenue from 31st Street to 34th Street; Grove Avenue from 32nd Street to 34th Street; Ogden Avenue from Lombard Avenue to Harlem Avenue. Refer to the map, attached to Ordinance 10-63, for precise boundaries of the districts.
   NEWSPAPERS AND OTHER PUBLICATIONS. Includes newspapers, periodicals, advertising circulars, and all other printed materials that may be distributed through the use of news racks.
   NEWSPAPER-DISPENSING DEVICE. Any unmanned, self-service, or coin operated box, container, storage unit or other dispenser located in or upon, or projecting into, or over, any part of the public rights-of-way, and which is installed, used, or maintained for the display, sale, or distribution of newspapers and other publications. The device within a modular news rack that dispenses one newspaper or other publication, including the door, coin return mechanism, and associated hardware.
   PUBLIC RIGHTS-OF-WAY. Includes all highways, streets, alleys, sidewalks, parkways, and other real property or easements, which are owned or controlled by the city, including the areas above and below such easements, and which are reserved or used for pedestrian or vehicular traffic.
   PUBLISHER. The person of other legal entity selling, displaying, or distributing newspapers or other publications in a news rack.
