(A) Required.
(1) No person shall erect, locate, construct or maintain a newspaper stand on any public way or other public place without first obtaining a license therefor from the City Collector.
(2) No person shall construct a newsstand without first obtaining a permit therefor.
(B) Applications. Any person who wishes a license to maintain, or a permit to construct, a newsstand on the public right-of-way shall complete a written application therefor and forward it to the Director of Neighborhood Affairs. The application shall set forth the exact location of the newsstand, and include a sketch of the newsstand, containing accurate dimensions.
(C) Indemnification of city. Any business permittee who operates a newsstand from public property, including but not limited to parkways, sidewalks, boulevards, median strips, thoroughfares, streets or alleys, shall indemnify and save harmless the city against all liability, judgments, costs, damages and expenses which may, in any way, accrue against the city from or on account of any act or thing done by the permittee by virtue of the authority given in the license.
(D) License issuance.
(1) Upon receipt of a completed application as required by division (B) hereof, and upon payment of a license fee of $25, the City Collector shall issue the desired license upon the sworn statement that the license does not violate any of the provisions of these Codified Ordinances, unless the issuance of the license violates any provision.
(2) A license shall be issued automatically if a completed application is filed, in accordance with these Codified Ordinances, and the license is not granted or denied within 30 working days of the filing with the Director of Neighborhood Affairs.
(E) Transferability. No license or permit issued under this chapter shall be transferred.
