§ 809.03 AUTOMOBILE SALESROOMS.
   (A)   Defined. As used in this section, AUTOMOBILE SALESROOM means any building, structure, premises, enclosure, lot or other place in the city where the business of dealing in new or used automobiles, trucks or similarly self-propelled vehicles or parts thereof is conducted or carried on.
   (B)   License required. No person shall manage, conduct or carry on or operate the business of selling, buying, auctioning or exchanging new or used automobiles, trucks or similarly self-propelled vehicles, or parts thereof, in or on any building, structure, premises, enclosure, lot or other place in the city without first obtaining a license therefor.
   (C)   License applications. A person who wishes to engage in or who is now engaged in operating an automobile salesroom or automobile auction in the city shall make application for the license required in division (B) hereof and shall state the name of the applicant, the residence of the applicant, the approximate number of persons to be employed, the location of the place where new or used cars are to be sold and whether or not the application is for selling both new and used cars or for the buying and selling of used cars only. The application must state whether the business is to be operated in a building, a building and a lot or a lot only.
   (D)   Bond. The applicant shall execute and deliver to the city a surety bond of $1,000 insuring the city against violation of any of the provisions of these Codified Ordinances or any other ordinance of the city or law of the state in connection with the sale or handling of, or the dealing in, new or used cars, and against damage arising out of improper or unlawful conduct or operation of the business.
   (E)   State authorization required. At the time of making application for the license required in division (B) hereof, the applicant shall furnish to the City Collector a current valid license, issued by the state, to sell, buy, auction, or exchange, new or used automobiles, trucks or similarly propelled vehicles, or parts thereof, and a current valid State Department of Revenue sales tax number.
   (F)   Location. No person shall locate, build, construct or maintain an automobile salesroom licensed as required in division (B) hereof within 200 feet of any building used as a hospital, church or public or parochial school, or the grounds thereof, or on any block in which two-thirds of the buildings on both sides of the street are used exclusively for residence purposes.
