§ 806.01 CLASSIFICATION OF AMUSEMENTS AND ENTERTAINMENT.
   (A)   Definitions. For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      AMUSEMENT and ENTERTAINMENT. Shall be interchangeable and shall mean any exhibition, performance, presentation or show for entertainment purposes, including but not limited to any theatrical, dramatic, musical or spectacular performance, promotional show, motion picture show, video presentation, flower show, animal show, circus, rodeo, athletic contest, sport, game or similar exhibition, such as boxing, wrestling, skating, dancing, swimming, racing or riding of animals or vehicles, baseball, basketball, softball, football, tennis, golf, hockey, soccer, track and field games, tournaments for bowling, billiards and pool games and any other entertainment or recreational activities offered for public participation or on a membership or other basis, including but not limited to carnivals, amusement park rides and games, live and/or disc jockey or “canned music” for dancing, whether or not an admission fee, “cover charge” or other remuneration is required from the spectators and/or participants.
   (B)   Classifications. All amusements or entertainment exhibited for gain or for admission to which the public is required to pay a fee, are hereby divided into the following classes:
      (1)   First Class amusements, which include all establishments of a theatrical, dramatic, vaudeville, variety or spectacular character, all entertainments given in motion picture theaters and all exhibitions consisting of motion pictures;
      (2)   Second Class amusements, which include all shooting galleries, rifle ranges, archery ranges and miniature golf courses;
      (3)   Third Class amusements, which include noncharitable carnivals and any mechanical ride, game of chance, booth or refreshment or concession stand used in connection therewith; and
      (4)   Amusements and/or entertainment provided by an alcoholic liquor dealer (Class B-3, C-3 and D-3, as defined in Chapter 804).
