§ 804.13 LICENSE RENEWAL.
   (A)   The renewal of any license issued under this chapter is a privilege and not a vested right of any present license holder. Further, this renewal privilege shall not be construed as a vested right which will, in any case, prevent Council, by ordinance, from decreasing the number of licenses to be issued or renewed in the city.
   (B)   A licensee under this chapter may renew his, her or its license upon the expiration thereof, provided that:
      (1)   The person, copartnership or corporation, at the time of making an application for the renewal of any license issued under this chapter, is not ineligible for the issuance of a license under this chapter;
      (2)   The person, copartnership or corporation has submitted a sworn renewal application under division (C) hereof;
      (3)   The renewal applicant has, in all respects, complied with any request for an examination, under oath, by the Local Liquor Control Commissioner (or by an agent authorized to act on the Commissioner’s behalf) under § 804.05; and
      (4)   The premises for which the renewal license is sought are suitable for the purposes and are in compliance with all Building, Fire and Safety Codes of the city.
   (C)   Prior to any licensee receiving a renewal of his, her or its license upon the expiration thereof, the person, copartnership or corporation seeking the renewal shall submit to the Local Liquor Control Commissioner a renewal application, in writing, signed by the applicant if the applicant is an individual, or, if the applicant is a partnership, club or corporation, then by a duly authorized agent thereof, verified by oath or affidavit, and containing the following statements and information:
      (1)   If the renewal applicant is, at the time of making the renewal application, a sole proprietor individual, the name, age and current residence address of the renewal applicant;
      (2)   If the renewal applicant is, at the time of making the application, a copartnership:
         (a)   The name, age and current residence address of each general partner; and
         (b)   The name, age and current residence address of any limited partner owning more than 5% of the aggregate limited partner interest in the copartnership;
      (3)   If the renewal applicant is, at the time of making the renewal application, a corporation:
         (a)   The name, age and current residence address of each officer, manager or director of the corporation; and
         (b)   The name, age and current residence address of any stockholder owning, in the aggregate, more than 5% of the stock of the corporation.
      (4)   Whether or not any person under division (C)(1), (2) or (3) hereof would be ineligible for a license under this chapter upon a first application; and
      (5)   Whether or not any person under division (C)(1), (2) or (3) hereof is ineligible to be licensed by the State Liquor Control Commission under the laws, rules and regulations of the state.
   (D)   Any licensee who fails to fully comply with all license renewal application requirements contained in this chapter shall be subject to any penalties provided for in this chapter and, further, shall be ineligible for renewal of his, her or its license upon the expiration thereof.
